Canada HVAC online sale agreement – Installation Option

You have chosen to purchase the Equipment with installation services. Please note the following Additional Terms and conditions that apply to your purchase.

You agree and acknowledge that manufacturer and specifications of the Equipment have been selected by you and that we have not made any representation to you as to the quality or the fitness of the Equipment for your intended purpose. We are not providing any guarantee or warranty with respect to the Equipment other as set out expressly herein, and you are satisfied that the warranty coverage under the manufacturer’s warranty are sufficient and reasonable. To the extent permitted by law, any warranties or guarantees provided under sale of goods legislation are hereby excluded.

You will maintain and use the Equipment in compliance with the manufacturer’s recommendations, and all applicable laws. You hereby agree that we are not responsible for any losses, damages or injuries caused by the installation, removal or use of the Equipment.

We do not provide any warranty or guarantee for the purchase of Equipment without installation services. The parts warranty is provided by the manufacturer. The equipment (furnace or air conditioner only) comes with a 5 year parts warranty. When registered online at www.goodmanmfg.com you will receive a 10 year parts warranty. The registration must be done by the installing contractor or homeowner within 60 days of installation. There is an option to purchase extended labour warranty on the Canada HVAC website. This should be done at the time of purchase for your Equipment.

For Equipment purchased without installation services, you are solely responsible for determining that the Equipment (including without limitation the sizing of the Equipment) is appropriate for your requirements. Before proceeding with your order to purchase Equipment without installation services, we recommend that you consult with a licenced installing contractor to confirm that you are selecting Equipment that is appropriate for your requirements. We are not liable or responsible if the delivered Equipment is not appropriate.

For Purchasers of Furnaces, Water Heaters and other Gas Appliances. Please note that under applicable laws in Ontario, any gas appliances (such as a furnace or water heater) must be installed by a licenced gas technician (certificate holder). Please also note that the manufacturer’s warranty for such Equipment requires that it be installed by a licenced gas technician in accordance with the manufacturer’s installation guidelines, and also requires that the Equipment must be registered online within 60 days of installation in order to extend the 5 year parts warranty to ten years.

Canada HVAC Online Sales Agreement – No Installation Option

For Purchasers of Air Conditioners. Please note that under applicable laws in Ontario, an air conditioner that must be wired into a premises must be installed by a licenced electrical contractor. In some cases, it is acceptable for a licensed refrigeration mechanic to wire the air conditioner into the panel. It is your responsibility to check with the Electrical Safety Authority and installing contractor to confirm if an electrician is required. All air conditioner installations require a permit be registered with the Electrical Safety Authority to ensure the installation has been done in compliance with all electrical safety codes and regulations. Please also note that the manufacturer’s warranty for such Equipment requires that it be installed by a licenced electrical contractor, or in some cases by a licenced refrigeration mechanic, in accordance with the manufacturer’s installation guidelines, and also requires that the Equipment must be registered online within 60 days of installation in order to extend the 5 year parts warranty to ten years.

We will contact you to arrange delivery of the Equipment. We will endeavour to ensure delivery of the Equipment on your selected Delivery Date. If that is not possible, we will arrange a mutually agreeable alternate delivery date within 30 days of your indicated Delivery Date.

We will provide you with a completed copy of the Agreement together with the Additional Terms and Conditions. You agree that we can provide this document electronically to the address that you have provided to us. You agree and acknowledge that you cannot cancel or terminate this Agreement, except as expressly provided herein.

You hereby authorize us to correct any errors on the face on this Agreement, including without limitation, improperly calculated taxes, and incorrectly spelled names and any other errors and omissions, and such amendments shall not invalidate this Agreement or any term herein and shall be binding on you without notice.

It is the express wish of the parties that this Agreement and all notices relating to it be drawn up and executed in English. Les parties conviennent et exigent expressément que ce document et tous les avis qui s’y rapportant soient rédigés en anglais.

This Agreement, together with our Terms of Use (LINK) and Privacy Policy (LINK), contains the entire agreement between the parties and may not be amended except in writing (or as otherwise contemplated in the Terms of Use or Privacy Policy) and shall be binding upon and inure to the benefit of the parties hereto, their permitted successors and assigns. This Agreement shall be governed by and construed in accordance with the laws of the Province or Territory where you reside at the time of the execution of this Agreement, and the federal laws of Canada applicable in that jurisdiction. If any provision of this Agreement is held to be invalid by a court, either completely or in part, the remaining provisions shall still be in effect and binding. You agree that any photocopy, electronic or faxed copy or reproduction of this Agreement

Canada HVAC Online Sales Agreement – No Installation Option will be binding upon you to the same extent as an original copy, and such photocopy, electronic or faxed copy or reproduction of this Agreement may be relied upon by us in any court proceeding against you.

We will arrange for installation of the Equipment to be completed on the Delivery Date by a qualified and (where applicable) licenced technician or contractor.

You agree and acknowledge that you cannot cancel or terminate this Agreement, except as expressly provided herein.
